The People of the State of Illinois, Attorney General of Illinois v DoorDash, Inc.

CIRCUIT COURT OF COOK COUNTY, ILLINOIS
COUNTY DEPARTMENT, CHANCERY DIVISION
Case No. 2024 CH 10011

On November 7, 2024, the Office of the Attorney General of Illinois (“Attorney General”) brought a lawsuit against DoorDash alleging violations of the Illinois Consumer Fraud and Deceptive Business Practices Act relating to DoorDash’s former “Pay Guarantee Model,” which DoorDash used to pay Dashers in Illinois between July 2017 through September 2019. The lawsuit alleges that DoorDash led Consumers to believe that their tips to Dashers would increase Dashers’ earnings above the pay DoorDash had promised Dashers. The lawsuit also alleges that DoorDash used Consumers’ tips to help satisfy the minimum pay it guaranteed to Dashers (“Guaranteed Amount”). DoorDash denies these allegations and maintains that all tips were paid to Dashers and the Pay Guarantee Model fairly and transparently compensated Dashers for their effort.

The Attorney General and DoorDash have agreed to settle this lawsuit. This Settlement includes the payments to Dashers who completed deliveries using DoorDash in Illinois between July 2017 and September 2019, were paid under the Pay Guarantee Model, and received tips for those deliveries which were allegedly used by DoorDash to satisfy the Guaranteed Amounts offered by DoorDash on those orders. The payment to each Eligible Dasher represents the proportional share of the Settlement Fund based on the amount of Consumer tips allegedly used by DoorDash to satisfy the Guaranteed Amounts offered to that Dasher by DoorDash when that Dasher accepted delivery orders between July 2017 and September 2019. Not every Dasher who completed deliveries using DoorDash in Illinois between July 2017 and September 2019, and received tips for those deliveries is eligible for a payment. Instead, only those who received a Consumer tip on a delivery allegedly used by DoorDash to satisfy the Guaranteed Amounts offered by DoorDash between July 2017 and September 2019 are eligible.

To receive your payment, you must fill out a Claim Form. The deadline to complete this form is February 10, 2025. If you complete the form by that date, you will receive your payment shortly after March 4, 2025.
